PUBLIC NOTICE No. 109 (RE-2008)/2004-09
NEW DELHI the 17th November, 2008

1. In exercise of powers conferred under Para 2.4 of the Foreign Trade Policy, 2004-09, the Director General of Foreign Trade hereby makes the following amendments in the Handbook of Procedures (Vol.1) (RE-2008):

2. The application form for EPCG Authorization (ANF-5A) in Handbook of Procedures (Vol.I) (RE 2008) is amended as under:-

(a) “Column No. 6 regarding details of Drug Manufacturing Licence is deleted.

(b) Condition No. 4(2) in the ‘Guidelines for Applicants’ would read as under:

“Self certified copy of IEM/SSI registration number in case of products and a self-certified copy of Service Tax Registration in case of Service Providers.”

(In case of Service Providers, who are not registered with Service Tax Authorities and a declaration in this regard has been submitted as a part of the application (Declaration No.10), Service Tax Registration is not required to be submitted. In such cases, RCMC from EPC concerned will suffice).

(c) The following declaration/undertaking is added as S.No. 13(a) after S.No. 13 of ‘DECLARATION/UNDERTAKING’:

“I/We undertake to submit a self certified copy of ‘Drug Manufacturing Licence’ in case of export of Pharmaceutical Product(s) within a period of three years from the date of issue of EPCG Authorization failing which the Bank Guarantee /Legal Undertaking executed/furnished at the time of clearance of Capital Goods with Customs authorities/Regional Authorities of DGFT, as the case may be, is liable to be forfeited/invoked and I/We would be liable to pay Customs Duty saved amount together with applicable interest thereon from the date of first import till the date of final payment”.
